The books I have been reading lately consider it separate from plants
and animals both, it's just algae.

I'm not a biologist, but the difference I'd use would be the cell
structure.

Plants have roots, stalks, leaves, etc, including a circulatory system.

Algae doesn't, it is just a single structure.
